In order to respect your trust, SANTAVIAPRO guarantees, as a priority, the protection of your personal data and the confidentiality of our customers (hereinafter "Your Data").
For complete transparency, in order to guarantee you a secure use of the SANTAVIAPRO website in all its available versions and related applications (hereinafter the "SANTAVIAPRO Site"), we set out how we process your data, so that our services are always in accordance with the respect of your rights. In this way, we ensure the security, confidentiality, and integrity of your privacy and data across all our platforms.
Our policy and we ourselves guarantee that all necessary precautions are taken to protect all your data against disclosure, loss, or alteration. We therefore provide you with all the information needed to understand easily how we handle your data. This data will only be retained for as long as necessary for the management and processing purposes determined. You will of course be able to access and modify your data at any time, as it will be available on your personal account on the SANTAVIAPRO site.
To these ends, we strive to take all necessary steps to comply with applicable data protection law.
Accordingly, SANTAVIAPRO hereby commits, through this personal data protection policy, to respecting the essential principles of the European General Regulation and French law on personal data protection, by providing you with information about the existence and modalities of the data processing applied here (paragraph 3), the rights you have regarding your data, and by implementing those rights ourselves (paragraphs 6 and 10). Any information regarding potential transfers to a third country or recipients is also made available, as is the data retention period (paragraph 5) and security measures (paragraph 9).
1. WHO ARE YOU?
When we refer to "you" in this Personal Data Protection Policy, it is simply because it is directly related to you and concerns you as a customer of SANTAVIAPRO, whether you have placed an order on the SANTAVIAPRO site, created a customer account without having ordered products or services, or browsed as a visitor on the SANTAVIAPRO site without having created an account or placed an order.
2. FOR WHAT PURPOSES DO WE PROCESS YOUR DATA?
2.1 When do we collect your personal data?
Your personal data may be collected if you visit the SANTAVIAPRO site using cookies, if you create a customer account on the SANTAVIAPRO site, place an order for one of our products or services, or have agreed to be a member of our newsletters (SMS, emails).
Your personal data is used to streamline your browsing on the SANTAVIAPRO site and to offer you a more personalized experience. We can thus best process your orders, enable installment payment, prevent fraud, process refunds, and manage your customer reviews.
2.2 Your browsing on the SANTAVIAPRO Site
In order to enable your browsing on the SANTAVIAPRO site, we process your data on the legal basis of your consent.
2.3 Processing of your orders
To handle and process your orders, we use your data. This use serves to manage mediation, customer relations (including through social networks), our after-sales service and remote sales, our marketing and commercial prospecting activities for the SANTAVIAPRO site, as well as order management, delivery, and shipping. The performance of the contract between the two parties (you and us) is the legal basis for this data processing.
2.4 Installment payment
For orders eligible for installment payment and for certain customers, your data is processed in order to offer you this payment option. The performance of the contract is the legal basis for data processing; however, your consent remains the basis for the processing of your banking data.
2.4.1 Klarna
To offer you Klarna's payment options, we may transmit to Klarna your personal data, including your contact information and order details, so that Klarna can assess whether you qualify and adapt the conditions to your needs. Your transferred personal data will be processed in accordance with Klarna's privacy policy.
2.5 Customer reviews
To share your reviews with our customers and visitors and allow you to leave feedback on the SANTAVIAPRO site, we use your data on the legal basis of your consent or legitimate interest.
2.6 Debt collection and fraud prevention
We use your data to enable debt collection and fraud prevention, as well as to guarantee the security of payments. The performance of this contract between both parties and the legitimate interest of SANTAVIAPRO as data controller are the legal bases for this processing.
2.7 Advertising management operations
SANTAVIAPRO's advertising operations are managed through the use of your data. This serves to grow our customer and prospect databases, manage technical and prospecting maintenance, conduct commercial statistics and advertising campaign studies, update prospecting files, manage promotional contests and lotteries, and handle solicitations.
3. WHERE DOES YOUR DATA GO?
Your data is shared with several internal SANTAVIAPRO departments. It is not sent to third parties, except in the situations specified below:
To process your orders, your personal data may be transmitted to various providers specializing in bank transactions, customer relations, after-sales service, delivery, IT development, site management, or the provision of warranties or insurance.
For installment payments, your data may be shared with providers such as payment and transaction centers (banks, etc.), call centers for business process or customer experience management, or, for customer reviews, to a customer review collection and processing manager.
SANTAVIAPRO's advertising network is also managed, through your data, for advertising clients and advertisers.
4. DATA RETENTION
The data collected by SANTAVIAPRO is retained only for the time and purposes necessary to carry out the operations described in paragraph 3 of our personal data policy.
Prospect data is kept in current archives for 3 years from the last customer contact. There is no intermediate archiving of this data.
For orders, data is archived in current archives for 5 years after the end of the use of the customer's orders, and in intermediate archives for 5 years after the end of retention in current archives.
Banking data is archived in current archives for the entire validity period of the bank card (plus one day). No intermediate archiving is performed for banking data.
Cookie usage and duration are detailed in paragraph 7 of our policy.
5. EXERCISING YOUR RIGHTS
5.1 You have the right to request access, modification, and rectification of your data.
5.2 You have the right to request restriction of the processing of your data. This applies if you contest the accuracy of your personal data, if you believe the processing is unlawful and request a restriction rather than erasure, or if you need the data for legal claims despite us no longer needing it.
5.3 You have the right to request the deletion of your data. If you require the deletion of your personal data, SANTAVIAPRO may retain it in intermediate archive format for the time necessary to fulfill its legal, accounting, and fiscal obligations.
5.4 You have the right to object to processing used for commercial prospecting purposes. For email prospecting, you can unsubscribe from newsletters by clicking the "unsubscribe" link available in all newsletters, or by visiting the contact page of the SANTAVIAPRO site. For SMS prospecting, you can unsubscribe by texting "STOP SMS" to 36007, or by visiting the contact page of the SANTAVIAPRO site.
5.5 You have the right to transmit post-mortem instructions regarding the retention, deletion, and communication of your personal data.
5.6 You have the right to request data portability.
5.7 You have the right to withdraw your consent for processing based on that legal basis. Note that withdrawal does not affect the lawfulness of processing carried out before withdrawal.
5.8 You have the right at any time to file a complaint with the competent supervisory authority (in France, the CNIL: www.cnil.fr).
To exercise your rights, send your request (including your email, name, first name, copy of your ID, and postal address) to the SANTAVIAPRO Data Protection Officer by email at contact@santaviapro.com and/or by mail to SANTAVIAPRO. We will respond within a maximum of one (1) month from the date of receipt.
